NERC Transfers Regulatory Oversight of Plateau Electricity Market to State Commission

The Nigerian Electricity Regulatory Commission (NERC) has issued an order transferring regulatory oversight of Plateau State’s electricity market to the Plateau State Electricity Regulatory Commission (PSERC), In line with the amended Constitution of the Federal Republic of Nigeria and the Electricity Act 2023 (Amended).

Under the provisions of the Electricity Act 2023, NERC retains its role as the central regulator for inter-state and international electricity generation, transmission, supply, trading, and system operations. However, the Act allows states that wish to establish and regulate their own intrastate electricity markets to formally notify NERC and request the transfer of regulatory authority.

In a statement released on Friday via its official X handle, NERC confirmed that the Plateau State Government had met all legal requirements and formally requested the transfer of regulatory oversight.

Following the order, Jos Electricity Distribution Plc (JED) has been directed to establish a subsidiary, JED SubCo, which will assume responsibility for the intrastate supply and distribution of electricity in Plateau State.

“JED shall complete the incorporation of JED SubCo within 60 days from 12th March 2025. The sub-company shall apply for and obtain a licence for the intrastate supply and distribution of electricity from NSERC, among other directives,” NERC stated.

The commission further mandated that all transfers outlined in the order must be completed by 12th September 2025.

With this development, Plateau State joins Lagos, Imo, Ogun, Ondo, Ekiti, Enugu, Niger, Edo, and Oyo in independently regulating its electricity market.
