The Supreme Court has dismissed an appeal filed by Rivers State Governor, Siminalayi Fubara, challenging the judgment of the Court of Appeal, which upheld Martin Amaewhule as the Speaker of the Rivers State House of Assembly.
A five-member panel of the apex court struck out the appeal, marked SC/CV/1171/2024, after Fubara’s counsel, Yusuf Ali (SAN), applied to withdraw it, citing that “events have overtaken the appeal.” However, he did not elaborate on what he meant by that statement.
Lawyers representing the respondents, including Wole Olanipekun (SAN), Joseph Daudu (SAN), Tuduru Edeh (SAN), and Mini Ayua, who appeared for members of the Amaewhule-led faction of the Assembly, did not oppose the withdrawal.
However, Olanipekun and Daudu requested a cost of ₦2 million each, arguing that both parties had already joined issues in the case. The court granted their request, with Justice Uwani Abba-Aji, who presided over the panel, delivering the ruling.
